Terms of Service

By accessing or using Shift ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. The Service

Shift is an open-source file conversion platform that allows you to convert files between supported formats including images, audio, video, documents, and SVG to React components. The Service is provided under the GNU Affero General Public License v3.0 (AGPL-3.0).

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.

3. Acceptable Use

You agree not to use the Service to:

  • Upload, convert, or distribute files containing malware, viruses, or malicious code
  • Process files containing illegal content, including but not limited to child sexual abuse material
  • Violate any applicable local, national, or international law or regulation
  • Infringe the intellectual property rights of any third party
  • Attempt to reverse engineer, exploit, or disrupt the Service or its infrastructure
  • Use automated tools to abuse the Service (e.g. bulk conversion bots that circumvent rate limits)

We reserve the right to suspend or terminate access to the Service for violations of these terms without prior notice.

4. Uploaded Files

  • You retain full ownership of any files you upload.
  • By uploading a file, you grant us a limited, temporary license to process it solely for the purpose of performing the requested conversion.
  • Uploaded files and conversion outputs are permanently deleted within 24 hours.
  • You are solely responsible for ensuring you have the right to upload and convert any file you submit to the Service.

5. Intellectual Property

The Shift source code is licensed under AGPL-3.0. You are free to use, modify, and distribute it under the terms of that license. The Shift name, logo, and visual identity are not covered by the AGPL license and remain the property of the Company.

6. Availability

We make no guarantee of uptime or continuous availability. The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue the Service at any time without prior notice.

7. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that conversion outputs will meet your requirements.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Shift and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of revenue, or corruption of files, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. If you have not paid us anything, our total liability is limited to USD $10.

9. Indemnification

You agree to indemnify and hold harmless Shift and its contributors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any files you upload to the Service

10. Governing Law

These Terms are governed by the laws of Chile, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Chile.

EU/EEA users: Nothing in these Terms limits your rights under applicable EU consumer protection or data protection laws, including the GDPR.

California residents: Nothing in these Terms limits your rights under the CCPA/CPRA.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
